Résumé de la thèse

Depuis plusieurs décennies, les questions de consommation sont au centre des enjeux politiques, économiques et juridiques. En Europe, le droit de la consommation trouble autant qu’il captive. Tentaculaire, il apparait comme une arme efficace des intérêts des consommateurs. Instrument du marché, il rassure le consommateur, favorise les transactions et optimise la concurrence. Dans l’ordre interne, le droit de la consommation apparait comme une véritable branche du droit tendant à revendiquer une certaine indépendance en raison de son champ d’application particulier (un consommateur ou non-professionnel). Par ailleurs, le droit de la consommation tend à s’immiscer dans les autres branches du droit compte tenu des critères d’application qui sont les siens. Cette immixtion soulève la question de la nature particulière du droit de la consommation : est-ce un droit spécial à vocation générale ? un droit général à vocation spéciale ? et au-delà de ces interrogations, le droit consumériste soulève la question de son articulation avec les autres branches du droit, notamment, le droit immobilier. L’immeuble de logement, parce qu’il est un bien sensible, est au centre de l’attention des législateurs civils et consuméristes. Depuis 1967, les règles civiles pour garantir la sécurité des opérations économiques sur le logement se multiplient. Saisi par le droit civil d’abord, par le droit de la consommation ensuite, l’accédant à la propriété d’un logement (et plus globalement le consommateur immobilier) fait figure de contractant vulnérable justifiant toutes les protections. Ainsi, réfléchir sur « les protections du consommateur immobilier », telles qu’elles prolifèrent dans l’ordre interne, c’est d’une part s’intéresser aux contours de la notion de consommateur immobilier et d’autre part explorer les rapports qu’entretiennent entre elles les règles ayant pour objet la protection du consommateur immobilier et celles ayant pour effet de protéger ce consommateur si peu ordinaire. Ce travail doctoral propose de réaliser une étude d’ensemble des protections attachées à la notion de consommateur immobilier. Il propose une analyse consumériste de ces protections bâtie sur deux idées en tension : la diversité et la cohérence.

Thesis resume

For several decades, consumer issues have been at the centre of political, economic and legal issues. In Europe, the law of consumption disturbs as much as it captivates. Tentacular, it appears as an effective weapon of the interests of consumers. As an instrument of the market, it reassures the consumer, promotes transactions and optimizes competition. In the domestic order, consumer law appears as a true branch of the law tending to claim a certain independence because of its particular field of application (a consumer or non-professional). On the other hand, consumer law tends to interfere with other branches of the law, taking into account the criteria for its application. This interference raises the question of the particular nature of consumer law : is it a special right with a general vocation? a general right with a special vocation? and beyond these questions, consumerist law raises the question of its articulation with other branches of law, notably real estate law. The housing complex, because it is a sensitive asset, is at the centre of the attention of civil and consumer legislators. Since 1967, civil rules to guarantee the security of economic operations on housing have multiplied. Seized first by the civil law, then by the consumer law, the person acquiring ownership of a dwelling (and more generally the real estate consumer) appears as a vulnerable contractor justifying all the protections. So, think on “real estate consumer protections”, as they proliferate in the internal order, on the one hand, it is to take an interest in the contours of the concept of real estate consumer and on the other, to explore the relationship between the rules on the protection of the real estate consumer and those on the effect of protecting that consumer so little ordinary. This doctoral work proposes to carry out an overall study of the protections attached to the notion of real estate consumer. It proposes a consumerist analysis of these protections built on two ideas in tension : diversity and coherence.
